Court System

  1. The City Courts (aka Municipal Courts) have criminal jurisdiction over misdemeanors and petty offenses committed in their city or town. The judges in these courts hear traffic cases such as DUI's, hit-and-run cases, and reckless driving, as well as violations of city ordinances and codes and they can issue orders of protection and injunctions prohibiting harassment.
  2. The Justice Courts have civil jurisdiction over lawsuits when the amount in dispute is $10,000 or less, collection cases, negligence actions, breach of contract cases, consumer complaints against businesses, and landlord/tenant disputes. They have criminal jurisdiction over cases including preliminary hearings on felonies, assault and battery, DUI, bad checks, underage drinking and violations of orders of protection or injunctions against harassment. This court also hears small claims cases where the amount in dispute is $3,500 or less.
  3. The Superior Court is Arizona's general jurisdiction court and can handle cases including equity cases, criminal cases amounting to a felony, misdemeanors, forcible entry, matters of probate, divorces, evictions of renters, and cases where the value of property is $1,000 or more.
  4. The Court of Appeals is an appellate court that hears and decides cases in three judge panels, reviews all decisions properly appealed to the court, and they have jurisdiction in all matters properly appealed from the Superior Court.
  5. The Supreme Court is the second appellate court and they may choose to review a decision made in the Court of Appeals. They also review misconduct against attorneys, regulate activities of the State Bar of Arizona and oversee admission of new attorneys to the practice of law, and they have to hear cases where a death penalty is involved.
